The Legal Protection of the Worker’s Right to Digital Disconnection Outside Official Working Hours: ”A Study within the Framework of Libyan Law”
Abstract
This study addresses the topic of “The Legal Protection of the Worker’s Right to Digital Disconnection Outside Official Working Hours”, a modern right that has emerged as a result of digital transformation and the expansion of communication technologies in the workplace. The research aims to clarify the concept of this right, analyze its connection to the element of subordination in the employment contract, and assess the adequacy of the Libyan legal framework in protecting workers from employer overreach beyond official working hours. It further evaluates the sufficiency of current legal provisions in addressing modern digital challenges.
The study concludes that Libyan labor law lacks explicit provisions safeguarding the worker’s right to disconnect and that existing legal texts do not keep pace with contemporary digital developments. Accordingly, the researcher recommends amending the Libyan Labor Law or enacting a specific legislation that clearly establishes this right, while also promoting institutional awareness of its importance in preserving the balance between professional and personal life for workers.
