Challenges of Transitional Justice in Libya Balancing Accountability and Reconciliation in the Post-Conflict Era An Analytical Reading
Abstract
The current research paper aims to identify the challenges facing transitional justice in Libyan society. Transitional justice and national reconciliation pose a major challenge and are worthy of study, especially at this sensitive historical stage, which calls for greater efforts to build a state of law and a constitution and achieve "transitional justice and, subsequently, national reconciliation." This is to emerge from the current situation, which has led to the emergence of internal conflicts, wars, and disputes fueled by external parties. This has resulted in a political and institutional divide, resulting in a deterioration in the level of services provided to citizens. From this perspective, this research paper focuses on research and study of the concept and content of transitional justice and national reconciliation within the framework of a balance between accountability and reconciliation, as they are an important means of addressing the current situation in a way that allows for a way out of the current crisis. It also attempts to examine and deconstruct the problematic situation of deciding priorities between justice and reconciliation, and how to arrive at a vision that clarifies this ambiguity that hinders peace, stability, and construction in a way that contributes to overcoming the current ordeal.
